Ghazi Chaouachi

Following his appearance on Shams FM radio station on May 12, 2022, Ghazi Chaouachi reported that there is circulating news related to the resignation of Prime Minister Najla Bouden and other Ministers, which was not executed by President Kais Saied. On May 13, 2022, Ghazi Chaouachi posted on his personal Facebook page a publication in which he indicated that the Lawyers Representatives Branch informed him about the decision to refer him to the investigating judge at the Court of First Instance in Ben Arous for “Disrupting public order and obstructing the government’s work.” Media outlets later confirmed that the Minister of Justice permitted the Public Prosecutor at the Court of Appeals in Tunis, by virtue of the provisions of Article 128 of the Code of Criminal Procedure, to take the necessary legal actions against Ghazi Chaouachi on the pretext of accusing a public official illegal of conduct illegal activities related to his position, without providing evidence, and diffusing false information to disrupt public order through audiovisual means of communication, in addition he wasn’t summoned to a judicial session for the matter. Whereas what Ghazi Chaouachi stated does not target anyone, and it can be refuted. Besides, he has the right to express himself and discuss the developments of the political scene, as he is an opposing politician, and as the Secretary-General of a political party with a parliamentary bloc, he can call for the government’s resignation.

In a second case, the Minister of Justice filed a complaint against the victim, Ghazi Chaouachi, on November 2, 2022, under Article 24 of Decree No.54, on the grounds of a media statement in which he reported the attempt of the Tunisian Authorities to fabricate a number of files with the aim of imprisoning several opponents. He was accused of disseminating rumors and false information, as well as false accusations against a public official. It was scheduled that he would appear before the investigating judge at the 18th office of the Court of First Instance in Tunis to hear him in this case on April 25, 2023.
