On May 12, 2020, Attorney Chaouki learned that a complaint had been filed against him by a member of the “Free Bloggers” group, in his capacity as president of the National Anti-Corruption Body for 2017. The complaint stated that the report prepared by the international management for disposition and auditing revealed many irregularities within the body’s financial, administrative, and logistical management. The investigating judge at the Economic and Financial Judicial Pole of the Court of First Instance in Tunis has set a first date to hear Dean Chaouki on January 12, 2024. Later, a request to postpone had been submitted to postpone it to 19th January. A third postponement request was later submitted, but a date has not been announced yet.

On August 6, 2021, the public prosecution opened an investigation. During these years, the Regional Bar Branch was not informed of any scheduled hearing, nor did the General Prosecutor’s Office at the Court of Appeal in Tunis send any summons to the concerned party to submit his responses. On August 20, 2020, an order was issued to place him under house arrest. Subsequently, he posted on his social media account, that he was informed through a report, a copy of which he did not receive. At 12:20 AM by virtue of Decision No. 507 dated August 20, 2021, issued by the responsible for the affairs of the Ministry of Interior to place him under house arrest until the expiration of the state of emergency by December 31. This decision was canceled in October of The same year, and the judicial files remained on the shelves of the courts, which Attorney Chaouki Tbib, in his media statements, considered to be judicial harassment and attempts to undermine him morally and financially through the several malicious charges against him.

The violation did not stop there, for on January 8, 2024, while he was at Tunis-Carthage airport intending to travel to attend a meeting of the Arab Defense Team formed by the Palestinian Bar Association to plead before the International Criminal Court. Upon arriving at the Border Police Department, he was informed that he should go through another security check. He was then informed by the police commissioner at the airport that the public prosecution in Tunisia had banned him from leaving and requested him to head to the Economic and Financial Judicial pole.

When Mr. Chaouki learned from the airport police commissioner that he was required to stay in Tunisia until he was interrogated, he, along with the president of the Regional Bar Association, went to the investigation office. The branch president was surprised that Attorney Tbib had not been officially summoned by the judicial authorities, despite his name being involved in the said case. The investigator informed him that the Mr.Tbib had missed a previous interrogation session, thus the travel ban taking place. This surprised the president of the Regional Bar Association, as this procedure contradicted the law and customary practices in the legal profession, which require notifying the regional branch and summoning the lawyer if the client cannot be directly informed.

He also pointed out that it was impossible to impose a travel ban without hearing the accused, giving him an opportunity to present his arguments, and enabling him to exercise his right to defense, especially since the case dates back to 2020. In light of the continuation of these prosecutions, the lawyer announced an open sit-in at the lawyer’s House and a hunger strike starting April 30, 2024, which according to his blog post, was under the slogan ”Hunger rather than submission,” to denounce the harassment he was facing. On 2nd May, he suspended the hunger strike, but he continued the sit-in, which he also suspended on May 14, 2024. According to his media statements, he made the decision in light of the recent events that took place in Tunisia, which required him to devote himself, like many lawyers, to defense tasks, such as attending sessions, participating in defense team meetings, and visiting prisons.

[249
231
232
236
post-8472","violations","type-violations","status-publish","has-post-thumbnail","hentry","ecupation-lawyer","case_status-231","governorate-tunis","violation_type-travel-ban
["GET
